Terms and Conditions

These are the terms and conditions governing the
provision of training services by Reflect BSL.

1. Definitions
1.1 “Client or Customer” shall mean the company or individual
that completes a course booking form or enters into a
contractual agreement;
1.2 “Delegate” shall mean the party or parties named as
attendees on the course booking form;

2. General
2.1 These terms and conditions shall apply to all training carried
out in the provision of services by Reflect BSL to the
Customer in accordance with any order confirmation
authorised by the Customer.
2.2 No additions to, or modifications of, these terms and
conditions shall have effect unless expressly agreed in writing
by both parties and expressed to be amendments to these
terms and conditions.

3. Acceptance of Order
3.1 Bookings can be accepted at any time up to the course start
date, subject to availability;
3.2 An official confirmation must be received from the
Customer in order to reserve a place. Prior to your
confirmation, your place is only held provisionally;
3.3 Confirmed bookings can be made by letter, fax or email
(provisional bookings can be made by telephone or email).
Bookings will only be confirmed on receipt of written
authorisation plus payment;

4. Substitutions, Rescheduling and Cancellations
4.1 Delegate substitutions may be made prior to the start of the
course without penalty, providing Reflect BSL is informed in
writing. It is the Customer’s responsibility, having referred
to relevant Reflect BSL course information, to ensure the
course is suitable to the Delegate’s requirements;
4.2 Delegates accept full responsibility for the full cost of the
course they enrol on, even if their employer is funding. They
must also agree and acknowledge that fees will not be
refundable unless the course fails to run;
4.3 Cancellations by Customers made more than 30 days before
course commencement will not incur cancellation charges;
4.4 Cancellations within 7 days of course commencement will
incur a 100% cancellation fee, and between 8 and 30 days
will incur a 50% cancellation fee;
4.5 A written cancellation notice is required in all circumstances.
4.6 Reflect BSL undertakes to provide the training course on the
date specified except when external circumstances prevent
this. In these circumstances Reflect BSL will endeavour to
re-run the course on a mutually agreeable basis;
4.7 Reflect BSL reserves the right to cancel a course, though we
make every effort to ensure this does not occur. In the
event of a course being cancelled by Reflect BSL, alternative
dates will be proposed or a full refund of monies paid will be
made to the Customer.
4.8 Reflect BSL takes no responsibility for loss of profit and/or
for any incidental, consequential, special or indirect losses as
a consequence of exceptional cancellations;

5. Pricing and Payment
5.1 All course fees published by Reflect BSL are fixed. Reflect
BSL reserves the right to review and amend prices;
5.2 The course fees include tuition and training materials as
appropriate to the course;
5.3 Course fees should be received by Reflect BSL 30 days prior
to the course start date or on booking (later of the two);

5.4 No training services will be provided unless payment
conditions have been satisfied;

6. Delegate Suitability
6.1 Delegates should read and understand the course outline
and met the necessary prerequisites; it is the Customer’s
responsibility to ensure training is suitable for delegates.
6.2 Reflect BSL reserves the right to ask a Delegate to leave the
training event if the Delegate does not meet the course
6.3 Reflect BSL urges Delegates to support this policy, which is
designed to protect the Customer’s investment;
6.4 All Delegates will be required to abide by any site rules and
regulations operating at the course location;

7. Force Majeure
7.1 Reflect BSL shall be entitled to delay, cancel delivery or
reduce the amount delivered if it is prevented, hindered, or
delayed in the provision of services due to circumstances
beyond its reasonable control, including but not limited to,
strikes, lock outs, accidents, war, fire, acts of God, reduction
in or unavailability of power, break down of plant or
machinery or shortage or unavailability of raw materials
from normal sources of supply;

8. Limitation of Liability and Indemnities
8.1 Except as may otherwise be expressly provided in these
terms and conditions, all warranties, conditions, terms,
undertaking and representations of any kind whatsoever,
express or implied, whether by statute, common law or
otherwise, are hereby excluded by Reflect BSL to the fullest
extent permitted by law and Reflect BSL shall have no other
obligation, duty or liability whatsoever in contract, tort,
statute or otherwise to the Customer;
8.2 Reflect BSL represents and warrants that the services
provided will be performed in a professional and skilful
manner consistent with the professional standards and the
general customs and practices of the industry;
8.3 Reflect BSL accepts no liability for the failure of any third
party hardware, software and/or systems which may be the
subject of any Reflect BSL services; this includes failure to
meet its operating specification;
8.4 No part of the training material may be reproduced, stored,
or transmitted in any form, or by any means, electronic,
mechanical, photocopying or otherwise, without prior
permission in writing of Reflect BSL or the copyright owner;
8.5 All Intellectual Property Rights for any product or service
remain the property of Reflect BSL unless otherwise stated
or agreed;

9. Disclaimer
9.1 The information contained in all Reflect BSL coursework and
literature is distributed on an ‘as is’ basis, without warranty.
While every precaution has been taken in the preparation of
the training courses and associated literature, neither the
author nor Reflect BSL shall have any liability to any person
or entity with respect to any loss or damage caused or
alleged to be caused directly or indirectly by the instructions
contained in the coursework or by the computer software
and hardware products described in it.
